General Terms and Conditions of Business and Use (GTC) – jijilo (SaaS)

1. Scope, contract types (B2C/B2B), definitions
These GTC apply to all contracts concerning the use of the online platform jijilo (“Service”, “Platform”) between jijilo and users (“User”, “Member”, “Customer”).
jijilo is aimed both at consumers (B2C) and at business users (B2B), especially in the case of multi-user tenants, for example coaches, consultants or teams.
Deviating terms and conditions of the User shall apply only if jijilo expressly agrees to them in text form.
2. Positioning: productivity and organization tool – not a recruiter, not a job board
jijilo is a technical productivity and organization tool for the individual management of job searches and applications.
jijilo is not a job market/job board, not a recruiter, not an intermediary and not a representative of employers; jijilo does not act as an intermediary in recruitment.
jijilo does not guarantee success: there is no entitlement to, and no guarantee of, suitable jobs, matches, responses, interviews or employment.
3. Subject matter of the service / technical service
jijilo provides technical functions, including the recording/import of job offers, tracking/status workflows, reminders/deadlines for follow-ups, document management, statistics, scoring and AI-supported assistance — depending on the plan, credits and quotas.
jijilo visualizes, structures and filters data entered or imported by Users. The content of job advertisements typically originates from third parties or from the User.
4. Third-party content, third-party sources, availability: job boards, authorities, aggregators
Third-party content, for example job advertisements, company information or publications by public authorities, does not originate from jijilo. jijilo assumes no warranty for the timeliness, accuracy, completeness or continued availability of such third-party content.
Functions based on third-party sources, such as URL import/parsing, aggregators, APIs or AI services, may be restricted, blocked, made subject to charges or discontinued by third parties. jijilo may adapt, limit or deactivate such functions for legal, security, stability or cost reasons.
5. Freemium, plans, credits, fair-use quotas
Many basic functions are free of charge. Advanced functions are available, depending on their configuration, either only in paid plans, against credits or within specific quotas.
Quotas are based in particular on resource and operating costs, such as storage, RAM/CPU and database usage, third-party provider costs, such as API requests and aggregators, as well as token and AI costs. These limits serve the fair-use principle in order to ensure fair and stable access for all Users.
In paid plans, limits may be increased. The currently applicable service and pricing overview and plan description, which form part of the contract, shall be decisive.
jijilo may adjust quotas and fair-use limits where this is necessary and reasonable for Users. Material changes will be communicated transparently.
6. Registration, account, security
Use of the Service requires a user account. Users must provide accurate information and keep their access credentials confidential.
Users are responsible for actions carried out through their account insofar as they are responsible for such actions. If misuse is suspected, jijilo must be informed without delay.
7. Multi-user tenants (B2B/B2C): invitations, rights, responsibility
In multi-user tenants, a tenant owner/administrator may invite additional users and manage permissions/functions, for example AI, exports, email sending and statistics.
The tenant owner is responsible for:
(a) assigning roles,
(b) internal data sharing,
(c) selecting and configuring functions, and
(d) complying with applicable laws in the tenant context, for example data protection obligations towards invited users.
Invited users have no entitlement to permanent access. If the tenant owner withdraws access, the right of use ends without entitlement to an own plan, credits or other rights, unless separately agreed.
AI / Scoring / Decision Support
8. AI decision support: non-binding, no automated decision-making
jijilo may provide automated analyses and suggestions, for example matching indications, prioritization, “strengths/weaknesses” or text suggestions, solely as assistance. No decisions are made automatically.
Users remain solely responsible for decisions made on the basis of such suggestions, for example application strategy, selection of jobs or contents of applications.
Results may be incomplete, inaccurate or biased and must not be used as the sole basis for decisions.
jijilo is not designed to analyze or profile sensitive data within the meaning of the GDPR, meaning special categories of personal data; Users should not enter such data unless strictly necessary.
Notices/labels in the interface, for example “AI suggestion – non-binding”, are an integral part of the risk communication; Users must critically review AI results.
9. CV uploads, documents, prompts: consent, rights, sensitive data
When Users upload or have documents analyzed, for example CVs or cover letters, these data are processed by automated systems. By using the analysis functions, the User consents to such automated processing.
Users warrant that they hold the necessary rights to the submitted content and that they do not infringe any third-party rights.
Users are requested not to upload sensitive data that are not necessary for the intended purpose. jijilo may support functions for reduction/anonymization; however, complete anonymization is not guaranteed.
When external AI services are used, data may be transmitted to third parties; see Section 11.
10. Free prompt field, especially in paid plans: prohibition of unlawful analyses of third parties
If jijilo provides a free prompt field, the User undertakes not to use the Service for the analysis, evaluation or profiling of third parties without their consent.
In particular, unlawful purposes, discriminatory content, violations of personality rights, as well as the creation or reinforcement of unfair or unlawful decision profiles are prohibited.
jijilo is entitled to block content/prompts, limit functions or suspend accounts if there is sufficient suspicion of unlawful use.
11. Third-party AI services, location outside the EU/EEA
Certain AI functions are based on third-party services, for example API providers. Processing may take place in accordance with their terms; details and any third-country transfers are set out in the Privacy Policy.
Some models/providers may be operated outside the EU/EEA. Users should therefore not process sensitive data through AI inputs.
12. AI limits, credits, BYOK, own inputs
AI functions are subject to quotas for fair-use reasons and may, depending on the plan, consume credits.
Paid plans may include higher AI quotas.
Where offered, the User may store their own API keys (“Bring Your Own Key”, BYOK). These are stored in encrypted form in accordance with the state of the art. The User is responsible for confidentiality, costs and the terms of the third-party provider.
With BYOK, input/prompt configuration may, where provided, be extended; the User is responsible for the content and legal compliance.
Import, Email Sending, Statistics, Misuse
13. URL import/parsing/extraction: private use only, no mass scraping, no redistribution
jijilo may technically support the import of job information from a URL through parsing/extraction. This function is subject to quotas and rate limits in order to prevent abusive extraction.
Content imported via URL is intended exclusively for personal/private use for the User’s own job application.
Users are responsible for complying with the terms of use of the source website as well as copyright and database-law requirements.
The following are prohibited:
(a) automated, massive or systematic extraction,
(b) circumvention of technical protection measures,
(c) provision of an import API for reuse by third parties, and
(d) publication or redistribution of imported content.
jijilo does not guarantee the extraction quality, completeness or accuracy of imported data. Source websites may block the function at any time; jijilo has no influence over this.
14. Email sending: only at the User’s initiative, anti-spam protection
Emails are sent exclusively at the initiative of the User. jijilo does not carry out unsolicited, automatic mass sending.
Users undertake to comply with applicable rules on electronic communication, in particular to avoid unreasonable harassment/spam.
To protect against misuse and incorrect sending, jijilo limits email sending functions by recipient and time period, for example daily limits per recipient/period, and logs sending operations for security and evidentiary purposes.
15. Statistics and tracking within the Platform
Statistics are based on the data recorded/imported by the User and may be incomplete or inaccurate.
Statistics serve orientation/productivity purposes and do not constitute a guarantee of results or “performance” of the job search.
16. Misuse/exploits: immediate measures
In the event of abusive or improper use, exploitation of bugs/exploits, circumvention of protective measures or unlawful content, jijilo is entitled to block functions, suspend or delete accounts — if necessary without prior notice.
In such cases, there is no entitlement to compensation/refund, insofar as legally permissible.
Data, Backups, Exports, OneDrive, Account Deletion
17. Hosting, third-party infrastructure, availability, risk of data loss
jijilo uses infrastructure/services of third parties, including hosting/cloud, databases, storage, networks, email and API services. 100% availability is not owed.
Despite appropriate security measures, data loss, data corruption or a security incident cannot be completely excluded — particularly in the event of disruptions at the hosting/cloud provider. In such cases, jijilo cannot technically or factually guarantee restoration.
18. Backup/export in the Platform: ZIP/CSV/JSON/SQL/documents, timestamp backups for tenants
Users may create an export at any time under Settings → Data Management → Backup/Export.
The export may be provided as a ZIP archive and may in particular contain CSV, JSON, SQL, for example a database export, as well as documents/attachments, insofar as stored in the account.
For tenants, jijilo may offer the creation of timestamped backups (“timestamp backups”).
Users are expressly encouraged to regularly back up important data externally.
19. Cloud export to OneDrive
Where offered, exports may be transferred to an external cloud service, for example Microsoft OneDrive.
OneDrive is a third-party provider. The User is responsible for:
(a) a valid account,
(b) permissions/access protection, and
(c) compliance with the third-party provider’s terms.
The availability and security of data in OneDrive are outside jijilo’s sphere of influence.
20. “Privacy and Data”: export of private data, backup before account deletion
Users may request an export of private data in the “Privacy and Data” section.
In this section, jijilo may additionally provide a backup option, especially before account deletion, so that Users can export their data before deletion.
21. Deletion, reset, inactivity (“stale data”)
Users may delete data and, where provided, trigger a reset to factory settings.
jijilo may delete data/accounts in the event of prolonged inactivity (“stale data”), especially for free accounts, in order to ensure storage and system security. Prior notice with an export option will be given beforehand, insofar as reasonable.
Specific deadlines will be communicated in the service description or in the account notices.
Payment, Withdrawal, Credits
22. Prices, payment, activation, immediate availability
Prices, scope of services, quotas and any credit packages are set out in the pricing/service overview.
After successful payment, the plan/credits are generally activated promptly; activation to the exact second is not owed.
Credits are usage balances for specific functions. Consumed credits are non-refundable. Unused credits are refunded only if this is required by law or expressly promised.
23. Withdrawal right for consumers: principle, digital services vs. digital content, compensation for value, events
Consumers generally have a right of withdrawal in distance-selling transactions.
Digital services, such as SaaS plans: immediate commencement of performance does not automatically exclude the right of withdrawal. Under the statutory requirements, in the event of withdrawal, compensation for value may be due for services provided up to the time of withdrawal, especially if the consumer expressly requests that jijilo begin before the expiry of the withdrawal period.
Digital content, not supplied on a tangible medium, where offered: the right of withdrawal may expire under the statutory requirements if the consumer expressly consents to performance beginning before the expiry of the withdrawal period and confirms their knowledge of the loss of the right of withdrawal.
Date-bound leisure/event services, where offered: there is no right of withdrawal for contracts concerning services related to leisure activities if the service is scheduled for a specific date or period.
jijilo provides the withdrawal instructions and the model withdrawal form during the ordering process.
Changes, Liability, Force Majeure, Final Provisions
24. Changes to the GTC and services: 14-day objection period
jijilo may amend these GTC and the services if this is necessary for legal, technical or business reasons, or if it improves user-friendliness and the change is reasonable.
Changes will be announced in good time, by email or Platform notice. Users may object within 14 days. In the event of an objection, the contract may be terminated if continuation under unchanged terms is not possible. If no objection is raised, the changes shall be deemed accepted.
25. Liability: “as is”, decisions by the User, data loss/hosting provider outage
The Service is provided — insofar as legally permissible — “as provided” (“as is”). jijilo assumes no guarantee for specific results or success in the job search.
jijilo shall be liable without limitation in cases of intent and gross negligence as well as in the event of injury to life, body or health.
In the event of slightly negligent breach of essential contractual obligations, liability is limited to the typical, foreseeable damage under the contract.
Decisions: insofar as legally permissible, jijilo is not liable for decisions made by the User on the basis of suggestions/analyses, especially AI, scoring or statistics.
Data loss: except in cases of intent/gross negligence, jijilo is liable for data loss only to the extent that the damage would not have been avoidable even if the User had properly backed up their data; see export/backup functions in Sections 18–20.
Hosting provider/third-party provider outage: for outages, data corruption or data losses that lie exclusively within the responsibility of third-party providers, jijilo shall be liable only insofar as jijilo is responsible for the cause.
26. Force majeure
Events outside jijilo’s sphere of influence, for example natural disasters, war, official measures, large-scale power or internet outages, release jijilo from its performance obligations for the duration and scope of the impairment; deadlines shall be extended accordingly.
27. Data protection, data processing agreement (B2B)
Data protection information is governed by the Privacy Policy.
For B2B tenants, where necessary, a data processing agreement (DPA) may be offered, especially if the tenant processes personal data of third parties in jijilo.
28. Place of performance, place of jurisdiction, choice of law, severability
The place of performance and payment is Düsseldorf, insofar as legally permissible.
For business users, the place of jurisdiction is Düsseldorf; jijilo may also bring proceedings at the registered office/place of business of the business user.
German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection remains unaffected.
Should any provision be invalid, the remainder of the contract shall remain valid; the statutory provisions shall apply in place of the invalid provision.
